My dad had never met her until we went to court. She says he followed her but he does not have time for such things. He did not even know Mrs. Armistead had a mailbox to follow her from. How long would a person have to sit at a mailbox waiting for someone that they had no idea what they look like. The picture Mrs. Armistead has on her homepage is very old. My mom and I both agree it looks nothing like her. How could my father know who to follow. Besides, he is in charge of 12 states for his company and with his work and all of
the things he and my mom do with us he does not have time. Besides, he gets along with everyone and would not have any thing to do with Mrs. Armistead.
I have watched the tape of the Unsolved Mysteries episode many times with my brother and we are begging my father and mother to sue Mrs. Armistead and the TV show. All he is guilty of is having an argument with her. She took it too far after that.
My father has made mistakes in the past but he has always admitted them. His first wife left him and their children and disappeared for 5 years. When she came back she married a truck driver and fought and got custody of my older brother and sister. My dad took them and left the state. After being gone for a few months he brought them back because he felt they needed both parents. They tried to charge him with kidnapping, but it was later dropped. He broke into his ex-wife's apartment to get his college ring and letter from the golf team because she would not give them back. And she had him arrested for that. When he met my mom 9 years after his first marriage, he told her every thing about his past. After she got to know my older brother and sister, they verified everything and my mom never held that against him. When they first got married he was a regional manager for a large computer company. He left to go to work for Microsoft and his first company would not pay him $8,000 in commissions they owed him so he refused to give them back a computer and printer until they paid him. they charged him with theft by taking. He gave back the equipment and never got his money. I think his employer was the criminal, not him. The judge agreed and only fined my dad a small amount. The one thing he regrets doing was charging personal items on a company credit card. He and my mom were having money trouble due to a bunch of medical bills. He admitted his mistake and turned his self in before the company even knew about it. He did not even have a trial. Mrs. Armistead call him a repeat criminal but he is not the person she claims. He said he hopes the solicitor trys to try him for stalking because the evidence is just like it was in the first trial where he was found not guilty. Anyone could have done those things.
Our phone number is public knowledge. Mrs. Armistead has even posted it in messages in the past. If anyone wants to call and talk to my mom or either of us they can feel free. We know what my dad is like and he is not the person Mrs. Armistead thinks he is. She is being bothered by someone else, not my dad.
Finally, Mrs. Armistead keeps talking about her daughter getting email. Let me tell you that she is not alone. Since mrs. Armistead has posted all this stuff about my dad, we get phone calls at all hours of the night. In addition, I have gotten over 20 email messages from people. One email message told me to "kill my dad". If she wants to go to court, we will show who is doing the stalking. Me and my little brother have agreed to testify in court and we are ready. My mom is ready and my older brother and sister said they will come up from Florida where they live. My mom and dad have over 100 people from church, scouts, and little league. Most of them are moms who love my
dad because he is so good with their sons. mrs. Armistead is going to look very rediculous if she tries to go after my dad. She really knows nothing about him. She needs to listen to Mark Barnett. He knows all of us from the fish club and knows how nice he is. When Mrs. Armistead called our church and talked to this lady, the ladt went to our pastor and our pastor called my mom and dad laughing. His exact quote was, "the crazy lady is calling again". These people have known my dad for
a long time.
We see that Mrs. Armistead is prepared to put a detailed story concerning my dad on her web page. She needs to take some advice from a 12 year old. DROP IT. My dad has done nothing to you and you are digging a very deep grave for yourself. Our pastor said, "let her have enough rope and she will hang herself". Well that is what is going to happen if she continues with this obsession.

Since you do not use your name I can't address this, but this is intended for more people than just you.
You do not know the facts behind any of the situations my husband has been in so yours comments have no merit. He was in a courtroom last month and no matter how much Ms. Armistead-Smathers wants to fabricate evidence, there was none. That is why the trial ended the way it did. And with a woman judge, I may add. She has no evidence to support these ridiculous charges. If she thinks she does, then let's have a trial on the second charge. I welcome it, so I can answer this woman charges in court. Her evidence the first time was so weak my husband did not even have to testify. The defense did not even bring forth anything. After the prosecution rested they rested and let a woman judge render a verdict, which was NOT GUILTY. The judge then recommended they Noll Pros the other charge as the evidence is not
there.
Our family has all seen her new web site, and we are going to become very proactive as far as she is concerned. She has crossed the line. If she would like to discuss this, she is more than welcome to contact me. She contacted MSNBC concerning her ridiculous allegations and we spoke to them this past week. After her UNSOLVED MYSTERIES episode she better be very careful. We are talking to an attorney, but the problem is she has no money to take. NBC and UNSOLVED MYSTERIES is another matter, although NBC has dropped the program for the new year and it is moving to NBC. Anyway, her actions will be dealt with.
None of you knows what he went through in his first marriage. The mistake he made was in ever bringing his children back. They both have net access and have been following these ridiculous claims that this woman has made so do not be surprised if they respond publicly. his daughter already has once.
Now if everyone wants to continue this discussion, then we will all respond. My husband was told not to contact Ms. Armistead-Smathers in any way as a condition of the other charge being Noll Pros and he has not. However, they will have a hard time stopping me or other members of my family from responding to these unwarranted attacks. She has crossed the line, and I personally am going to see that she has her own day as a defendant in court. She says on her page that he claims to have followed her. He never made that claim and she knows it. Believe me, he has no interest in that type of person. After seeing her mother in court, I can't believe that she would agree with the things her daughter has on her web site. She did seem like a nice
person.

Mr. Walton, she continues the assault. Today she put the above on her web site. It does not bother me as our civil trial attorney has told us to give her enough rope so she can hang herself.
What is wrong in her statement is not that she could not prove who dialed the phone, but what the statute of harassing phone calls says. It says that REPEATED calls have to be made for the purpose of harassment. They had all these phone records that showed one call from our residence, and the call lasted 10 seconds. The call was made because of the following email being sent to us.

I took out the last 2 digits so whoever has this number now will not be harassed.
Once a woman's voice was heard on an answering machine, the call was terminated. No one that we know, ever called her again. So one phone call does not constitute HARASSING PHONE CALLS, as far as the statute reads. That is why my husband was found "not guilty".
The stalking charge was dropped because there is no evidence my husband ever stalked this woman. She is in fact still stalking us. We welcome the solicitor trying the stalking case so we get rid of her threats. We have enough evidence of her stalking us by calling every organization we belong to. She has sought publicity from these charges and still does as she has contacted MSNBC since the trial.
My husband promised not to discuss these facts publicly, but they will not stop me from bringing these facts forward. I will bring forward the correct facts to any and all falsehoods she decides to spread on her home page.

Mr. Hillyard had nothing to do with the bitch page. I know first hand.

My wife came into the group on my behalf as well as my son. On the advice of our lawyer I have no comment in regards to her site.

Here is a simple answer. I had an argument with this woman a year ago. We have had further arguments, all in public newsgroups, which I never initiated. I never saw her before until we were in court. As sensitive as the courts are to "stalking cases", if there were any evidence at all, I would have been tried for that.
I had nothing to do with the "Bitch" page. Any further comments will be from my family or lawyer.
